Antitrust Litigation

Mintz Levin views questions involving the antitrust law as business questions. The goal of any review of these questions is to meet our clients’ business goals consistent with the antitrust laws. We understand that these questions often do not arise from a “still life” portrait; instead they usually emerge from a dynamic competitive environment. We are experienced in quickly reviewing that environment to determine the proper way to approach the issue and find a creative solution. Mintz Levin represents clients throughout the country in antitrust matters ranging from private treble-damage litigation to state civil enforcement proceedings and federal, civil, and criminal antitrust investigations.  We represent clients in connection with investigations and litigation brought by the Justice Department, Federal Trade Commission, the Consumer Product Safety Commission, Congressional Committees and state Attorneys General. We also have particular strength in the area of health care antitrust, regularly counseling and representing clients in matters such as hospital mergers, managed care antitrust issues, exclusive provider arrangements, and refusal to deal.
