DOJ Crackdown on Genetic Testing Telefraud

Mintz Member and Chair of the firm’s Health Law and Health Care Enforcement Defense Practices Karen Lovitch was quoted in an article included in the August issue of Laboratory Economics covering the continuous effort targeting fraudulent telemedicine arrangements. Karen commented on the national telefraud crack down and said, "Cancer genetic testing has been at issue in many of the telefraud schemes uncovered over the past few years, so it was inevitable that new schemes would emerge... The type of testing might differ, but the allegations remain the same – the testing is allegedly being ordered for patients who do not need it, and Medicare does not permit the testing to be used as a general screening test, so it was not medically necessary.”
