Beginning February 20, 2011, employers must answer new questions on the I-129 nonimmigrant visa petition form relating to whether the foreign national being sponsored for the visa requires an “export license.”
While our export control laws are not new, this is the first time that employers have had to make specific attestations to the U.S. government regarding export compliance in an immigration context. Sharing of the information across government agencies could result in enforcement actions outside the immigration context for export control violations.
