Mintz Levin Achieves Significant Victory Against Microsoft Corporation in Patent Infringement Case

New Trial is Ordered for Client, Uniloc, Inc., in Case Against Software Giant

Boston, MA - Uniloc, Inc., a security technology provider represented by Mintz, Levin Cohn, Ferris, Glovsky and Popeo, P.C., achieved a major victory in its patent infringement case against Microsoft Corporation when the Federal Circuit reversed a summary judgment and ordered the matter back to trial.

The United States Court of Appeals for the Federal Circuit reversed the Summary Judgment of the U.S. District Court for the District of Rhode Island (Uniloc USA, Inc. and Uniloc Singapore Private, Ltd. v. Microsoft Corp., U.S. Court of Appeals for the Federal Circuit, No. 08 1121, 8/7/08) of non infringement and remanded the matter back to the District Court for trial.  Uniloc alleged that the anti piracy software registration system of Microsoft's Product Activation system infringed on U.S. Patent No. 5,490,216.

The Federal Circuit concluded that the District Court erred in granting Summary Judgment by failing to credit this admission of Microsoft's affiants confirming that the same algorithms at issue were used in Microsoft's system.  The Federal Circuit also flatly rejected all of Microsoft's alternative claim construction arguments.
