Jury Awards Fifth Largest Verdict in Patent History
Boston, MA – A federal court jury awarded Uniloc, Inc $388 million in damages in a patent infringement case against software giant Microsoft Corporation. Mintz, Levin, Cohn, Ferris, Glovsky and Popeo, P.C. led by Paul Hayes and Dean Bostock, both Members in the Firm's Intellectual Property section, represented Uniloc.
Messrs Hayes and Bostock originally filed the case on behalf of Uniloc in 2003. The suit alleged that Microsoft had violated the company's patent for its anti-piracy software registration system. In August of 2008, the U.S. Court of Appeals for the Federal Circuit reversed the Summary Judgment of the U.S. District Court of Rhode Island and ordered the case to trial.
"This verdict validates our position that companies, regardless of their size and market share, must respect the rights of patent holders," said Mr. Hayes who is also the Chair of Mintz Levin's Patent Litigation practice. "The jury, when presented with the facts, clearly recognized that Uniloc did indeed have a valid patent, and Microsoft had infringed on our client's rights."
