The California Court of Appeals ruled in favor of Comcast and AT&T, affirming the trial court's judgment of dismissal of a consumer class action suit. A three-judge panel of the state court of appeals unanimously affirmed the judgment of dismissal, which was obtained last year when Mintz Levin attorneys prevailed on a motion to dismiss in California Superior Court. The court held that the "filed rate doctrine" barred the plaintiff's claims for damages.
