An analysis of recent 100 million and billion-dollar damages decisions and a look forward


Nowadays, if patent litigation is pursued through trial, there is a greater than ever possibility that a defendant will get hit with a more than 100 million or even billion-dollar jury verdict. In addition to raising the stakes in an already high-stakes area of the law, this recent explosion of eight- to ten-figure verdicts has resulted in an unprecedented examination of damages issues by district courts, the Federal Circuit, and even Congress. This program will not only address the enormous verdicts and the new damages case law, but will also offer patent damages strategies for both plaintiffs and defendants, from the early stages of the case through trial.
