Appellate 

Mintz Levin’s dynamic appellate practice allows us to serve clients skillfully throughout the litigation process, from pre-suit assessment to final appellate review.  Thinking about all our cases from an appellate perspective from the very outset enables us to frame the issues and make a record in the way that will achieve our clients’ goals most effectively and efficiently, both at the trial level and on appeal. 

Our experience is extraordinarily broad in scope and deep in substance.  Mintz Levin attorneys have appeared in cases before appellate courts at all levels, including the U.S. Supreme Court, U.S. Circuit Courts of Appeal, and numerous state appellate courts.  These appeals have covered a broad range of substantive areas including, antitrust, class actions, construction law, commercial law, communications, health care, insurance coverage, intellectual property, real estate and land use, securities, and white collar crime.  We have also frequently been engaged to author amicus briefs on behalf of industry associations and advocacy groups, including amicus briefs in two cases currently pending before the U.S. Supreme Court. 

Recent Successes

By combining the firm’s substantive depth with its appellate experience, we’ve achieved a strong record of appellate success.  Representative victories on behalf of our clients include:

  • A First Circuit decision rejecting an antitrust challenge to our client’s pharmacy network
  • A Seventh Circuit decision protecting bondholders from the potential loss of their investment in the United Airlines bankruptcy proceedings
  • A Federal Circuit decision affirming dismissal of a patent infringement claim that had been asserted against our client
  • A D.C. Circuit decision upholding FCC rules for sharing high-capacity network elements against challenges brought by incumbent telephone companies
  • A decision by the Connecticut Supreme Court that reversed an injunction and a seven-figure judgment against our client on trade secret and unfair competition claims
  • A decision by the Massachusetts Supreme Judicial Court protecting fast-track approval for affordable housing.
