Because we understand the business of insurers and reinsurers, Mintz Levin’s attorneys have earned a national reputation for their ability to handle complex, sophisticated coverage disputes and for their skill at addressing the legal implications of new, untested coverage issues as they emerge.  We have decades of successful experience representing carriers in state, federal, and bankruptcy court coverage lawsuits throughout the country, and have briefed, tried or argued virtually every relevant coverage issue (trigger, allocation, duty to defend, bad faith, occurrence, etc.).

We also have substantial expertise handling multi-party and multi-site coverage litigation at both the trial and appellate levels, as well as commercial coverage cases involving claims under errors and omissions, directors and officers, workers compensation, employers liability, and professional liability policies.  Our coverage experts frequently lecture and publish on the myriad issues facing insurers and reinsurers, including lead, asbestos, directors’ and officers’ claims, agent and broker issues, construction defects, tobacco, “follow the fortunes,” and pollution. 

We also have extensive experience representing insurance clients in rate-setting and other regulatory proceedings, and have litigated complex commercial disputes between insurance carriers—including unfair trade practices claims relating to the automobile insurance residual market and post-acquisition disputes involving life insurance books of business.
