Many clients have intellectual property assets sitting idle, which may seem to have little or no value because they are not currently active within the client organization and are not actively licensed. However, some of these assets may actually be incurring expenses due to periodic fees required to maintain their protected status. Our attorneys utilize a three-step process to determine the value of these assets:
Identify and assess intellectual property portfolio.
Determine which assets are being exploited and which are not.
Plan exploitation of those assets found to be idle.
The standard exploitation options include gifting the intellectual property asset, for which the company may yield a tax benefit (our tax attorneys assist in the details of determining the write-off value for donations to various types of for-profit and nonprofit entities); selling the asset; and licensing the asset to create a royalty stream. Of course, if third parties infringe on our client's Intellectual Property assets and those third parties refuse to take a license, our experienced Intellectual Property litigators stand ready to take appropriate legal action.
