Ernie’s practice focuses on representing cable operators, telecommunications companies, voice over Internet protocol (VoIP) service providers, and other businesses with regard to a range of regulatory issues involving the Federal Communications Commission (FCC), the Federal Trade Commission (FTC), the US Copyright Office, and other state and federal regulatory agencies.
Ernie’s telecommunications practice areas of interest and capability include regulation of telemarketing (by telephone, text messaging, and fax); federal and state Universal Service Fund (USF) matters; regulation of VoIP services; Customer Proprietary Network Information (CPNI) and associated rules on privacy of customer telephone records; E911 emergency calling requirements; Communications Assistance for Law Enforcement Act (CALEA) requirements; and regulation of Telecommunications Relay Services (TRS). Ernie has also assisted with regulatory due diligence reviews and obtaining regulatory approvals associated with mergers and acquisitions of telecommunications companies.
Among other matters, Ernie has assisted cable operators with statutory licensing at the US Copyright Office and with FCC regulations on program access, program carriage, broadcasters’ must-carry and retransmission consent rights, network nonduplication and syndicated exclusivity rights, sponsorship disclosure requirements, disability access, and the national Emergency Alert System (EAS).
During law school, he was executive articles editor for the Indiana Law Journal, and he also served as an intern for US District Court Judge David F. Hamilton. Prior to entering law school, Ernie enjoyed a successful career as a college administrator.
