Immigration Client Alert: Issuance of Interim H-1B Regulations Imminent

The U.S. Citizenship and Immigration Service (U.S. CIS) is on the verge of issuing interim regulations that would allow companies to file H-1B petitions for employees for immediate start dates. As many of you are aware, all 65,000 H-1B visas for Fiscal Year 2005 (October 1, 2004 to September 30, 2005) have been used. Except for exempt organizations (educational institutions and non-profit research institutions), no employer can get a new H-1B for an employee to start work before October 1, 2005.
