This is the second in a series of Client Alerts entitled Don't Defer: Immediate Action Required. The series is intended to keep clients and friends of Mintz Levin informed about the far-reaching reforms to non-qualified deferred compensation pursuant to the "American Jobs Creation Act of 2004." Our first installment in the series informed you about the reforms approved by the House of Representatives (H.R. 4520) on October 7, 2004, and previewed certain aspects of the U.S. Senate version of the bill. On October 11, 2004, the Senate approved its version, and the House and Senate Conference Report reconciled differences in the two bills and approved the final version of the bill. On October 22, 2004, President Bush signed the reconciled bill and the Act is now law. For your convenience, this Alert discusses the Act as signed by the President.
