Recent amendments to both the Telephone Consumer Protection Act (passed by Congress in 1991) and the Federal Trade Commission's (FTC) Telemarketing Sales Rule (mandated by the 1994 Telemarketing Act) have resulted in tougher regulation for telemarketers and more options for consumers to avoid unwanted telemarketing calls. The attached advisory is a summary and analysis of the FTC and Federal Communication Commission's (FCC) very recently adopted new regulations. It discusses how the rules apply to telemarketers as well as to companies who use third party telemarketing firms to conduct solicitations on their behalf, and includes a comparison of FTC and FCC telemarketing rules enforcement.
