LTC Matters: Avoiding the Malpractice Lawsuit: Managing Relationships as a Risk Management Strategy

By the time a malpractice action has been filed against a nursing home or other long term care provider, most of the defense attorney's key cards will have been dealth. He will not be able to change what the facility did or what happened to the resident, family staff attitudes toward the facility, or the facility's staffing and survey history. His ability to defend the lawsuit will depend in large part on whether the facility has taken staeps to deliver quality care and to document those steps. This publication discusses possible risk management strategies in the context of the litigation risks that they are meant to address. One particular risk management strategy, effectively managing relationships, is examined in detail.
