Video Podcast: A Guide to Municipal Bankruptcy

5/5/2008

On April 1, 2008, Mintz Levin's Rich Moche and William Kannel presented on topics relating to municipal bankruptcy. Their presentation is available as a video podcast.

Municipal credits, already stressed by post-retirement obligations to their employees, will now be dealing with declining assessed values and revenues resulting from subprime foreclosures and a declining housing market. Many are predicting a surge in municipalities, including assessment districts, filing for protection under Chapter 9 of the bankruptcy code.

Topic Covered:

  • Who can file a Chapter 9 petition? Can creditors force a filing?
  • What are the key differences between a Chapter 9 and a Chapter 11?
  • Why the best credit outside of Chapter 9 may be the worst credit in Chapter 9.
  • Where does Chapter 9 end and competing state law take over?
