On June 26, 2009, U.S. Citizenship and Immigration Services (USCIS) announced that it had asked the Office of Management and Budget to approve the continued use of the version of
Form I-9 currently posted on the USCIS website, despite the fact that the form as posted “expires” on June 30, 2009. The current form indicates a revision date of “2/2/09” at the bottom, but the USCIS also indicated that, once the form is “revised” (i.e., the expiration date removed and the revision date updated), employers will be permitted to use either version of the form. Our office will provide an update once a new version of the Form I-9 has been posted to the USCIS website, but until then employers should feel comfortable continuing to use the Form I-9 as posted beyond the June 30, 2009 expiration date.
