Health Care Reform Advisory: Understanding the Implications of Proposed Legal Structure Requirements of Accountable Care Organizations

Mintz Levin is publishing a series of advisories to assist the health care industry in understanding and responding to the proposed regulations for Accountable Care Organizations (ACOs) recently published by the Centers for Medicare & Medicaid Services.

This advisory discusses the proposed legal structure requirements for ACOs and their implications for health care organizations as they begin to evaluate whether to participate in the Medicare Shared Savings Program (the Program). The ACO legal structure requirements will have extensive transactional and regulatory effects on new and existing health care organizations that want to become Program participants and qualify for additional payments based on meeting quality and savings targets.
