On March 16 the Department of Homeland Security's Citizenship and Immigration Service (USCIS) published an update as to how many H-1B numbers have been taken for the next fiscal year, which commences October 1, 2006. As we have discussed in previous Client Alerts, there are only 65,000 new H-1B numbers each fiscal year, and with 6,800 reserved for citizens of Chile and Singapore pursuant to certain Free Trade Agreements, the cap is in reality 58,200. USCIS says that as of May 12, just under 35,000 H-1Bs have been approved or pending, leaving only 23,200 remaining.
