Antitrust Advisory: A Patent Does Not Automatically Confer Market Power

Earlier this month, the Supreme Court made it clear that having a patent does not automatically mean having market power.

With the ever-growing importance of intellectual property rights in every sector of the U.S. economy, the Court's decision will have a significant impact on both inventors and technology users. Patent holders will generally have more flexibility in how they bring their inventions to market while their licensees and consumers may see more bundling of products and services.
