This article, written by Mintz Levin attorneys Richard E. Mikels and Adrienne K. Walker, discusses the Supreme Court's plurality decision in Till v. SCS Credit Corp., 541 U.S. 465 (2004) and how it could be one of the most significant Supreme Court decisions on reorganizations since the passage of the Bankruptcy Code.

Rick has a national practice, focusing on insolvency and restructuring issues. He has represented companies both in bankruptcy and in out of court restructuring. Additionally, he often represents other constituencies, including secured creditors and acquirers of businesses, in Chapter 11 reorganizations. Representative Debtor Chapter 11 cases include Malden Mills, ACT Manufacturing, Inc., Filenes Basement, Inc., divine, Inc. and Great Northern Paper, Inc.

Adrienne has significant experience in workouts, restructuring and bankruptcy matters including representing debtors, creditors, and trustees. She is also experienced in creditors' rights, commercial litigation and commercial arbitration. In addition to representing debtors and creditors in Chapter 11 reorganization cases, Adrienne's recent experiences includes representation of indenture trustees, secured creditors, and creditors' committees.
