Mintz Member Ralph A. Campillo was featured in the Daily Journal’s 2019 Top Verdicts for his work to obtain an outright defense verdict on behalf of his client Encino Motorcars, LLC, and its owners, David L. Peterson and Steve Zubieta. The special report was published on February 19.
Mr. Campillo served as lead trial counsel in the contractual dispute, First Motor Group of Encino, LLP and Trophy Automotive Dealer Group LLC v. Encino Motorcars, LLC, David L. Peterson and Stephen Zubieta, which arose from Encino Motorcars and its owners’ $105 million sale of the Mercedes-Benz of Encino automobile dealership.
Plaintiffs sought more than $20 million, alleging that the financial information provided by Encino Motorcars and its owners was inaccurate, misleading, and breached representations and warranties contained in the Asset Purchase Agreement. On November 5, 2019, after more than three weeks of trial, the jury determined that Encino Motorcars and its owners had not breached the contract.
“This was a long-awaited and celebrated verdict, as Encino and its owners retained me to represent them in April 2004. After more than three weeks of trial in 2019, the jury came to a swift decision, compelled by our arguments that established convincingly that our clients had not breached their contract,” Mr. Campillo said. “It was a pleasure to deliver another positive outcome for this client, who I have successfully represented for many years.”
