Event Details

At one of SDIPLA's most popular annual events, a panel of judges from the U.S. District Court, Southern District of California, all of whom are part of the Patent Pilot program, will discuss issues regarding patent litigation in their courtrooms. The panel will be moderated by Howard Wisnia, a veteran IP litigator. Potential issues include:

  • Patent Trial Management post-AIA
  • The timing and resolution of Section 101 invalidity assertions post Alice and Mayo
  • The practical impact of the recent Supreme Court decisions concerning "exceptional case" determinations in attorney fee motions under 35 USC Section 285.
  • An overview of the S.D.Cal experiences with the patent pilot program and local patent rules
  • Best Practices for Markman Hearings, pre-trial preparation and trial presentations
  • Outlook on recurring issues in patent cases
  • Best Practices for the Pre-trial Order and Final Pre-trial conference
