Member Thomas Wintner spoke to Managing IP on the Government's claim that Moderna should be immune from patent infringement under Section 1498. Thomas shared, "a company could be immune from patent infringement claims but still be able to sue others, which some people might find unfair. That plays up a tension that has always existed but has never really been in the public eye."
