  • Represented Tatcha, LLC, a luxury skincare manufacturer and retailer, in the sale of a minority investment by private equity firm Castena Partners.

Employment, Labor & Benefits

  • Advised a beauty products company on a on a threatened sexual harassment matter involving senior-level executives. The Mintz team led an investigation into the claims, and also managed the ensuing mediation between the company and the individual threatening the claims, resulting in a a positive confidential settlement for our client.

Litigation

  • Represented Angles BeautyCare Group, Inc. in a jury trial concerning trademark infringement and unfair competition, obtaining a favorable settlement
  • Obtained voluntary pre-suit dismissal of California’s Business & Professionals Code section 17200 and 17500 claims in 2 matters for our client, a publicly traded marketing company for dietary supplement and cosmetics manufacturers.
  • Negotiated a successful settlement on behalf of JB Line, a cosmetics retailer, in a class action alleging violations of New York false advertising laws in connection with a beauty product.
  • Represented Perfumania, Inc. in a nationwide class action pertaining to alleged violations of the TCPA, with the plaintiffs seeking between $10 million and $20 million of damages. The case presented novel issues of liability under the TCPA, as well as standing to pursue class under the Supreme Court decision in Spokeo and its progeny. We mounted a spirited defense and obtained a settlement at a very small fraction of the claimed damages.
  • Defended a global manufacturer of over-the-counter health and beauty products in a class action alleging false and misleading statements on labels of homeopathic products, brought under California (UCL, FAL, CLRA) and Florida (FUDTPA) consumer protection laws.

Regulatory

  • Negotiated with FDA on behalf of a cosmetic client when a large shipment of imported products was detained by Customs and Border Protection due to non-compliant labeling and assisted company in developing plans for reconditioning the products.
Case Study
Mintz helped a manufacturer and retailer of luxury skin care products negotiate a favorable agreement to sell products through a televised home shopping network. The agreement protects the company’s future rights to distribute products through multiple channels.
Case Study
Mintz helped a hair products manufacturer respond to a violation notice concerning California’s proposition 65, which requires businesses to provide warnings about exposures to certain chemicals. Mintz established that the products were subject to the statute’s Safe Harbor provisions.
