The New Year is bringing along with it the resumption of the HHS Office for Civil Rights random audit program to assess compliance with the HIPAA privacy, security, and breach notification rules. Unlike Phase I of the OCR audit program, Phase II audits will be conducted by desk review of documentation, rather than on-site visits. Don’t let the format of the Phase II audit fool you — findings can absolutely lead to enforcement, and failure to comply can lead to civil monetary penalties. Are you ready?
