Ahoy! ITC Welcomes SEP Holders Navigating for the Best Venue

Member Reza Dokhanchy, Intellectual Property Division Chair Michael Renaud, and Associate Amy LoBue wrote an article featured in IP Litigator on why the US International Trade Commission is the best venue for standard-essential patent (SEP) holders to assert their patents, despite common misconceptions that SEPs cannot be successfully asserted there.

The authors write, “The ITC has repeatedly signaled it is willing to issue exclusion orders based on standard-essential patents. However, given the complications that arise in an SEP case that do not exist in an ordinary patent case, in order to succeed at the ITC, experienced counsel is a must.”
