Antitrust World Eyes Justices On AmEx Steering Case

Bruce Sokler, the Chair of Mintz’s Antitrust practice, was quoted in Law360’s article on a February 26th Supreme Court case regarding a dispute over anti-steering provisions in American Express merchant agreements. Economists and antitrust practitioners will be watching the decision and opinions of the judges closely both because of the precedent they could set for rule-of-reason matters, and because, as Bruce notes, cases with merits issues rarely go to the higher court.
