Dole Buyers Get Mixed Win In 9th Circ. Natural Label Ruling

Dan Herling, a Litigation Member in the Mintz San Francisco office, was quoted in this Law360 article on the mixed results derived from the Ninth Circuit’s decision in favor of the consumers bringing a major false advertising complaint against Dole for falsely labeling their frozen berry products as “all-natural.” The results are mixed, according to the article, because the consumers must now demonstrate a damages model that accounts for those consumers who do not care whether or not a product is natural.
