EPA Set to Designate PFAS as Hazardous Substances Next Month

Environmental Law Chair Jeff Porter told American Lawyer that he thinks many of the battles fought in the early years of the Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA) will soon be fought again over PFAS.

Jeff said, “I think we’re on the verge of another era that might not be quite as long, but it’ll be a few years of the same kind of litigation that we had at the beginning of my career about what’s the appropriate response to PFAS in a particular situation [and] who should pay for it.”
