ESG Fund Rules Reignite Debate on SEC’s Remit

Mintz Member Jacob Hupart was quoted in IFLR discussing the SEC's recent proposal to address greenwashing in the asset management community. Jacob spoke on some of the proposal's controversial aspects and said, "Some particular areas that are getting the strongest pushback from industry practitioners are greenhouse gas emissions and the demand for scope three disclosures... There's a safe harbour in place to a degree, but scope three is slightly amorphous in terms of the types and extent of the emissions it covers, so there's a greater degree of uncertainty... It's also considered a much more difficult area to measure, as it often involves external parties.”
