The Future of Federal Arbitration Act Practice After ‘Badgerow’

Member Suman Chakraborty authored an article published in the New York Law Journal discussing the impact of the Supreme Court’s decision in Badgerow v. Walters (2022) on the jurisdiction of federal courts in cases related to the Federal Arbitration Act (FAA). He emphasized the considerable challenges the ruling poses in establishing federal court jurisdiction for petitions to confirm or vacate arbitration awards based on federal questions. 

Suman wrote, “The FAA is not going anywhere, but parties will regularly find themselves in state courts when seeking to invoke its provisions.”
