Lookback Period Cut to Six Years in Final Overpayments Rule

 

Larry Freedman, a Mintz Washington, D.C. Member and health care and life sciences litigator, is quoted in this BNA’s Health Care Daily Report article on the final rule as it applies to Medicare overpayments, stating that providers will “be responsible for reporting and returning all overpayments identified within six years of when the overpayment was received.” Larry notes that it is significant that a clarification that ‘identification’ of an overpayment includes the ‘quantification’ of the overpayment amount.
