Stats Show Lack Of Risk In ITC's Domestic Industry Approach

 

According to a Law360 article co-authored by Mintz Member and Chair of the firm’s Intellectual Property Division Michael Renaud and Member Jonathan Engler, historical data shows that the International Trade Commission’s approach to the economic prong of the domestic industry requirement (DI) remains consistently favorable to complainants. Despite the recent perception that DI is becoming harder to satisfy, the commission has found the economic prong of DI met in the overwhelming majority of cases.
