2022 Executive War College

Karen Lovitch will be presenting on a session titled, "Important Developments in Laboratory Legal, Regulatory, and Compliance Requirements," at the 2022 Executive War College conference on April 27.  

This presentation will discuss the Eliminating Kickbacks in Recovery Act (“EKRA”) and its application to the laboratory industry. The presenters will discuss the origins of EKRA, which became law in 2018, and explain how DOJ has used the statute to date. The presenters will address significant recent court decisions that have interpreted the scope of EKRA as well as DOJ’s recent use of the statute to charge cases involving COVID-19 testing. The presenters will provide practical compliance tips and discuss how they see DOJ’s use of EKRA evolving in the future.
