Landmark Changes May Be Coming: State Senate Passes Bill Overhauling New York’s 126-Year-Old Antitrust Law

New York Law Journal published an article written by Jason P.W. Halperin, Robert KidwellEllen Shapiro, and Kristina Van Horn about the New York State Senate passing the Twenty-First Century Anti-Trust Act (SB 335), an amendment to New York’s General Business Law. In the article, the attorneys outline the biggest implications of the proposed law, including what would be the most comprehensive pre-merger notification program of any state in the country.

"If SB 335 becomes law, we can expect that private actions will be pursued by individual plaintiffs, corporate plaintiffs, and class action plaintiffs,” the authors write. “If passed, this law would mean highly significant, landmark reforms to New York’s antitrust laws, and thus, a markedly different landscape with considerably greater regulation for companies who do business in New York State."
