Mintz Achieves Denial of Class Certification for adidas America Inc.

Attorneys from Mintz, Cohn, Ferris, Glovsky and Popeo, P.C. successfully represented adidas America Inc. in arguing against certification of a class action suit involving one of the company’s popular running shoes. 

U.S. District Judge Alvin Hellerstein ruled that the plaintiff, Edward Ruffo, did not present sufficient evidence in his claim that adidas’ Springblade running shoes were defective.  The judge sided with the company saying that the plaintiff had not demonstrated that the shoes caused proposed class members to suffer as a group.  

“The attempt to make this claim a class action had serious flaws and the Court recognized that fact and ruled accordingly,” said Dan Herling, a Member of Mintz Litigation Practice.
