In Possible Precedent, Navy Agrees To Seek NPDES Permit For Munitions

Inside EPA quoted Environmental Law Chair Jeff Porter in an article about the Navy’s settlement of a Clean Water Act citizen suit by agreeing to obtain a National Pollution Discharge Elimination System (NPDES) permit for its continued operation of a firing range on the Potomac River. 

Jeff told Inside EPA, “We should absolutely expect that others will make similarly imaginative claims that, like firing munitions or fighting fires, other longstanding activities that have never been subject to Federal Clean Water Act permitting in fact require NPDES permits.”
