The Situation

Mintz has represented multibillion-dollar private real estate investment fund Colony Capital, Inc. (formerly Colony NorthStar, Inc.) for more than a decade in its acquisition, disposition, financing, and leasing of a substantial portfolio of commercial real estate throughout the United States. A significant component of this ongoing representation has been Mintz’s development of a comprehensive leasing program for Colony’s portfolio of office and industrial properties, including the development of master lease forms for use across Colony’s entire portfolio.

The Approach

Over the last decade, Mintz has negotiated more than 2,000 leases for office and industrial spaces within the Colony portfolio. The volume of leasing has covered hundreds of properties in more than 20 different geographical locations ranging in size from 1,000-square-foot industrial leases to several-hundred-thousand-square-foot office leases. Mintz, in collaboration with asset managers and managing directors at Colony, has created several master lease forms that can be easily adapted for use depending on the asset class, building type, and space size. The master lease forms are modified when appropriate to account for changes called for by the legal landscape or applicable market trends.

The Outcome

This effort has added significant value in streamlining lease management and administration for the client while substantially expediting lease drafting and lease revisions during the negotiation process.  The result has been an extraordinarily efficient and cost-effective representation for such a large portfolio.
