A Circuit-By-Circuit Guide To FCA Suits After High Court Snub

Member Laurence Freedman was quoted in a Law360 article exploring the U.S. Supreme Court's refusal to resolve one of the False Claims Act's most consequential controversies and how this is causing a divide in circuit courts. Laurence commented, "Whistleblowers, or relators, who lack inside information will have a strong incentive to pick relatively lenient venues. It will be interesting to see if the courts of appeals will converge, If not, I expect the split will deepen, and the data-mining, speculative and shot-in-the-dark cases by relators will be clustered in certain circuits."
