Citizen Suits Seek To Expand CWA Permitting As WOTUS Narrows Scope

Environmental Law Chair, Jeff Porter, spoke with Inside EPA about how environmental NGOs continue to sue EPA and other Federal agencies seeking to expand the reach of the Clean Water Act’s permit requirements even as the Supreme Court narrows the reach of the Act.

Jeff referenced Potomac Riverkeeper’s suit against the US Navy alleging that the firing of munitions is a “discharge” requiring a permit under the Clean Water Act and a similar lawsuit against the United States Forest Service alleging that the use of fire retardants to fight forest fires also required such a permit.
