Robotext Scam Bill Could Transform TCPA Landscape

Managing Member of the firm’s Los Angeles Office Joshua Briones, Associates Esteban Morales, and Adam Korn co-authored an article published by Law360 covering a new bill titled the "Robotext Scam Prevention Act" and how this bill could transform the Telephone Consumer Protection Act. The authors summarized, "The Robotext Scam Prevention Act is meant to revise the definition of an automatic telephone dialing system, by striking 'using a random or sequential number generator'... the change being proposed would redefine an ATDS by removing the phrase 'using a random or sequential number generator' and replacing it with 'or sent a text message'... If enacted, this change could transform how businesses across the entire country can contact consumers and reopen the door to lawsuits that have been shut closed."
