Bret Cohen, Michael Renaud, and Nicholas Armington wrote an American Bar Association Business Law Today article entitled Explaining the Defend Trade Secrets Act. It provides an overview of the law, including how it provides American companies with greater protection against trade secret misappropriation. The article also examines key provisions of the act, such as a uniform definition of “trade secret,” a new civil seizure mechanism that serves as a preventive tool for trade-secret owners, and whistleblower immunity and related notice provision that may require immediate revision of employment agreements.
