Join Mintz as we discuss the new H-1B regulations from the DOL and DHS. The DOL regulations, issued earlier this month, dramatically increase prevailing wage data, which is used to evaluate H-1B, H-1B1, E-3, and PERM cases. When the DHS regulations take effect in early December, they will restrict eligibility for H-1B qualification and create additional burdens for employers that place H-1B workers at another company’s worksite. We will explain the new rules and review practical solutions for employers as well as the potential impact of litigation challenging these rules.
