  • A Year Since the FCC's Declaratory Ruling — Critical Issues and Latest Trends on TCPA

The Telephone Consumer Protection Act (TCPA), enacted in 1991, remains one of the most popular laws that Congress has ever passed. The TCPA provides a number of consumer protections – including a prohibition on solicitation calls before 8 am and after 9 pm; requiring companies maintain “do not call” lists; and extensive prohibitions on “robocalls” or calls made from an automated dialing system. Unfortunately, the TCPA also imposes severe penalties on companies that violate the law and has become a favorite weapon of class action lawyers. Nearly a year ago, the FCC’s Declaratory Ruling and Order clarified some obligations but has created other questions, spawning additional requests for further relief. On June 28, join Mintz Levin and ML Strategies for a webinar where our team will provide a comprehensive overview of the TCPA issues facing companies. Specific areas include:

  • Key issues resolved in, and created by, the FCC's 2015 Order
  • Emerging action in Congress to address the TCPA issues
  • Overview of pending TCPA petitions before the FCC
  • Recent TCPA issues before the judiciary system
  • The Spokeo decision's expected impact on TCPA litigation
  • Steps to prevent and defend class action claims
  • Best practices to ensure TCPA compliance
  • Key industries, including health care and communications, most impacted by TCPA
