The Telephone Consumer Protection Act (TCPA), enacted in 1991, remains one of the most popular laws that Congress has ever passed. The TCPA provides a number of consumer protections – including a prohibition on solicitation calls before 8 am and after 9 pm; requiring companies maintain “do not call” lists; and extensive prohibitions on “robocalls” or calls made from an automated dialing system. Unfortunately, the TCPA also imposes severe penalties on companies that violate the law and has become a favorite weapon of class action lawyers. Nearly a year ago, the FCC’s Declaratory Ruling and Order clarified some obligations but has created other questions, spawning additional requests for further relief.
