Immigration Courts Are 'Ignoring The Law,' Mass. Judge Says

An article published by Law360 covered a motion hearing in a class action lawsuit, Pereira Brito v. Barr, filed by Mintz, together with the ACLU of Massachusetts and the ACLU of New Hampshire, challenging the government’s practice of denying due process to detained immigrants.

At the hearing, U.S. District Judge Patti B. Sari said she planned to certify the class of Massachusetts detainees, and that immigration judges around the United States appear to be ignoring federal court rulings that say the government should bear the burden of proof at civil detention hearings.

The article included a quote from Special Counsel Andrew Nathanson. The Mintz pro bono team representing the plaintiffs in this case includes Mr. Nathanson and Members Susan Finegan and Susan Cohen, and Associates Mathilda McGee-Tubb and Ryan Dougherty.
