Mark represents leading corporations and institutional clients in complex antitrust and financial litigation. He has significant experience guiding both plaintiffs and defendants through high‑stakes disputes in federal and state courts across the country.

For more than a decade, Mark has handled all phases of litigation, including major trials and arbitrations, dispositive motion practice, and appeals. His work includes representing opt‑out plaintiffs with tens of billions of dollars in purchases in antitrust price‑fixing litigation involving the chicken, pork, and beef industries. He has also been part of teams that secured settlements exceeding 150% of their clients’ damage claims in matters involving LCD panels and cathode ray tubes — recoveries that far surpassed class‑action outcomes. 

Mark’s broader commercial litigation experience includes obtaining a Second Circuit reversal on behalf of BNY Mellon, defending a European investment group in the Delaware Chancery Court, and winning summary judgment for Barclays in litigation arising from the Lehman Brothers bankruptcy.

He has been recognized by Chambers USA, which ranked him as an Up and Coming lawyer in “Antitrust: Mainly Plaintiff” in New York. Lawdragon has also named him among its 500 Leading Global Antitrust & Competition Lawyers.

Before entering private practice, he clerked for the Hon. Mae A. D’Agostino of the US District Court for the Northern District of New York

Mark received his JD from Columbia Law School, where he was a Kent Scholar, and his BA, magna cum laude, from Boston College.

Experience

  • Representing a group of 16 opt-out plaintiffs, such as Costco Wholesale, McDonald’s, and BJ’s Wholesale Club, with tens of billions of purchases in antitrust price-fixing litigation against the major chicken suppliers, including as a key member of the team with respect to case management and interfacing with clients.
  • Representing a group of 13 opt-out plaintiffs with tens of billions of purchases in antitrust price-fixing litigation against the major pork suppliers, including as a key member of the team with respect to case management and interfacing with clients;
  • Representing a group of 10 opt-out plaintiffs with tens of billions of purchases in antitrust price-fixing litigation against the major beef suppliers, including as a key member of the team with respect to case management and interfacing with clients.
  • Represented a group of corporate opt-out plaintiffs who were victims of price-fixing in the market for LCD panels, including as part of the team that achieved settlements exceeding 150 percent of the plaintiffs’ damage claims and more than five times what they would have recovered from the class action.
  • Represented a group of corporate opt-out plaintiffs who were victims of price-fixing in the market for cathode ray tubes, including as part of the team that achieved settlements exceeding 150 percent of the plaintiffs’ damage claims and more than five times what they would have recovered from the class action.
  • Successfully defended a European investment group in a multi-year litigation brought by Carlyle Investment Management in Delaware Chancery Court, with each side to bear its own costs, involving the novel argument that litigation funding activities violated a release clause.
  • Obtained a complete reversal before the Second Circuit on behalf of BNY Mellon, reinstating its claim arising out of a large commercial mortgage loan issued by Morgan Stanley.
  • Prevailed on summary judgment on behalf of Barclays on its affirmative claim in interpleader litigation initiated by the Options Clearing Corporation arising out of the Lehman Brothers bankruptcy.
