Colin is an environmental lawyer who advises developers, owners, and other proponents on environmental requirements and risks associated with development projects. He also defends, and advocates for, companies across a range of industries in significant environmental cleanup and cost recovery disputes.  

Colin effectively leads and integrates into project teams by providing proactive environmental counsel in support of developers’ strategic goals. He advises on permitting requirements and sequencing, advocates before regulators to obtain approvals, negotiates with interested parties and abutters to resolve conflicts, and works collaboratively with architects, engineers, consultants and others. His counsel focuses on environmental regulation of waterfront development, including evolving requirements regarding sea level rise projections and associated adaptation and resiliency priorities. He also assists owners and developers in responding to growing attention by regulators to concerns about vapor intrusion.

Colin defends property owners and tenants and other industrial and commercial clients in disputes over the cleanup of contamination. He negotiates agreements to limit his clients’ obligations to investigate and cleanup, he coordinates review of technical reports, aggressively identifies opportunities for settlement, engages in multi-party allocation efforts, and advocates in court or before regulatory agencies.

Colin's experience includes:   

  • Identifying and executing environmental permitting strategies for development projects, especially with regard to waterfront development.
  • Advising on the environmental aspects of corporate and real estate transactions, including purchases, sales, mergers, debt offerings and lease agreements.
  • Litigating environmental cases in federal and state courts.
  • Advising in the remediation and redevelopment of contaminated properties under CERCLA and a variety of state regulatory programs in New England and across the U.S.
  • Counseling entities involved with manufacturing, transportation, energy, health care, and higher education regarding environmental compliance, response to regulator inquiries and enforcement actions, and negotiating and implementing settlements and allocation of responsibility in multiparty investigations.

Representative Matters

  • Actively involved in the firm’s representation of the General Electric Company in Superfund matters.
  • Counseled clients regarding compliance with RCRA hazardous waste regulations, project permitting under the Clean Water Act and the Clean Air Act, and enforcement proceedings including negotiation of administrative orders and consent decrees under TSCA, the Clean Air Act, and hazardous waste regulations.
  • Advised on the acquisition and redevelopment of a former manufacturing facility for commercial/residential use.
