Annually recognized as one of Massachusetts’ Super Lawyers Rising Stars, McKenzie is an experienced trial lawyer specializing in the criminal defense of both individuals and companies. McKenzie has successfully defended clients investigated and charged with a wide variety of crimes, including political corruption, health care fraud, securities fraud, gun and drug offenses, tax fraud, bribery, immigration crimes, and many other state and federal offenses.

In addition to her trial work, McKenzie has extensive experience representing clients before grand juries, conducting internal investigations, representing officers and corporations in connection with SEC investigations and enforcement proceedings, and arbitrations. 

In her career, McKenzie has represented clients facing investigation and enforcement actions undertaken by the Securities Exchange Commission, US Department of Justice, the US Attorney's Office, the Massachusetts Attorney General's Office, local District Attorney's Offices, and various other state and federal agencies.

Representative Matters

  • In 2012, McKenzie successfully defended a corporate client who was under investigation for allegedly falsifying data for product that was sold to the government. After Mintz’s thorough internal investigation and aggressive advocacy, the government declined to pursue a case.
  • In 2011, McKenzie successfully defended an executive of a well known institutional asset management fund who had been charged with securities fraud. After a multi-week trial, the judge found for McKenzie’s client and dismissed all charges brought by the SEC. The win was a rare trial victory against the SEC.
  • In 2011, McKenzie secured the pre-trial dismissal of all federal drug charges for a client facing a 10-year statutory minimum.
  • In 2009, McKenzie tried a federal cocaine distribution and felon-in-possession case that resulted in the complete acquittal of her client after a week-long jury trial.
  • In 2007, McKenzie successfully tried of one of Massachusetts’ largest criminal health care fraud cases. McKenzie’s client, a sales executive at a large, international pharmaceutical company, and three other former employees were completely acquitted of any wrongdoing after a month-long trial. The long and substantial government investigation into Medicaid fraud and anti-kickback violations resulted in the pharmaceutical company pleading guilty and settling for over $700 million.
  • From 2003 to 2009, McKenzie represented the former CFO of a Fortune 500 company in a multi-faceted SEC investigation, enforcement action, arbitration, and criminal investigation. Ultimately, the client prevailed with no criminal charges and a very favorable settlement with the SEC.
  • In 2003, McKenzie assisted with one of the largest health care fraud trials in United States history, which yielded the full acquittal of a pharmaceutical sales executive accused of, among other things, violating the federal anti-kickback statute and conspiracy. This national, multi-year government investigation into Medicare fraud allegations yielded millions of documents, hundreds of potential witnesses, and culminated in a federal jury trial that lasted three months.
