Marc is a versatile litigator whose practice encompasses criminal and civil cases, sensitive internal investigations, and wills, trusts, and estates disputes for high-net-worth individuals. He handles high-stakes matters for clients across a range of industries, including technology (with an emphasis on AI), life sciences, health care, financial services, real estate, energy (renewable and non-renewable), and construction. Marc represents US and international companies, boards and board committees, executives and public officials. He is particularly adept at avoiding, and when not possible, managing public and press exposure for his clients. He was recently named one of the top 100 “Leading AI and Legal Tech Advisors” in the country by a leading publication, having represented some of the most significant clients in the artificial intelligence industry, who consider him a trusted advisor.

As a go-to resource for clients at all stages of investigations and disputes, Marc regularly conducts internal investigations and helps clients avoid charges and litigation. When litigation is unavoidable, Marc represents clients in federal and state trial and appellate courts around the country, in arbitrations, and before regulatory agencies. In addition to his white collar and investigations practice, he also has an active wills, trusts, estates and conservatorship practice focused on managing complex and often multifaceted disputes for high-net-worth individuals. 

Prior to joining Mintz, Marc was a partner at a global law firm, where he served as the leader of the Northern California Corporate Investigations & White Collar Defense Practice and a co-leader of the firm’s Litigation – Trusts, Estates and High Net Worth team. Earlier, he practiced at a criminal defense boutique and at a San Francisco–based, full-service law firm. 

Marc served as a law clerk for the Honorable Marsha S. Berzon of the United States Court of Appeals for the Ninth Circuit, and the (late) Honorable Peter K. Leisure of the United States District Court for the Southern District of New York. In law school, he was an Articles Editor for the Columbia Law Review and a Harlan Fiske Stone Scholar.

White-Collar Criminal, SEC/Regulatory Enforcement, Public Corruption and Parallel Civil Proceedings

  • Represented former senior executive of renewable energy company Solyndra in investigations by two different U.S. Attorney’s Offices, Main Justice, federal regulators, and Congress that garnered global media attention and became a topic of interest in two different Presidential elections. Government declined to prosecute.
  • Represented an ultra-high-net-worth individual in a federal criminal tax investigation involving hundreds of millions of dollars at issue.
  • Represented a foreign-headquartered conglomerate, its U.S. subsidiary, and senior officers in investigations by two U.S. Attorney’s Offices and Main Justice into alleged wire fraud, tax fraud, and money laundering with potential exposure for client exceeding $500 million; led related internal investigation.
  • Represented defendant in the first insider trading cases concerning cryptocurrency ever brought by DOJ and SEC.
  • Represented an individual in federal and local investigations of alleged international fraud scheme resulting in the seizure of cryptocurrency valued at tens of millions of dollars. After replacing prior counsel who spent years on unsuccessful litigation, negotiated agreement to recover the vast majority of client’s assets in under six months.

  • Advised a Fortune 200 international conglomerate and its U.S. subsidiaries on a wide range of white-collar risk exposure across a diverse portfolio of businesses; provided strategic guidance to mitigate regulatory and enforcement risks.
  • Led internal investigation of elaborate fraud and embezzlement by a senior officer of an international manufacturer of laboratory equipment and the subsequent referral of the matter to federal prosecutors, resulting in the officer paying restitution to client of all misappropriated funds and all legal fees incurred in the investigation.
